Section 1 Scope of the general terms and conditions
1.1 We are Grohe Limited a limited company registered in England and Wales. Our company registration number is 00770795 and our VAT registration number is 707 6747 12. 1.2 All deliveries and services from Grohe are made exclusively on the basis of the following terms and conditions in the form that is valid at the time of the order. Unless otherwise expressly agreed upon in writing, deviating terms and conditions are not applicable.
1.3 Under these terms and conditions, ‘customer’ refers both to consumers and businesses. Under these terms and conditions, ‘consumer’ means an individual acting for purposes which are wholly or mainly outside that individual's trade, business, craft or profession. Under these terms and conditions, everyone else who is not a ‘consumer’ is a business.
Section 2 Our Contract with You
2.1 When you place an order, you are offering to purchase the product(s) from us in accordance with our terms and conditions. By placing your order you submit a binding offer to us for the purposes of concluding a contract with you.
We will send you an email within 24 hours of you placing an order to acknowledge that we have received it. However, your offer shall only be deemed to have been accepted by us when we send you confirmation of order acceptance via e-mail. The contract will come into effect when this confirmation of order acceptance is sent.
Placing Your Order with Us
2.2 You can look at products in detail without any obligation to purchase.
2.3 If we are unable to supply you with a product, for example, because that product is not in stock or no longer available or because of an error in the price on our site, we will inform you of this by email and we will not process your order. If you have already paid for the products, we will refund you the full amount.

Section 3 Saving & Using Your Personal Data
We collect and save data when you place an order, and when an order is concluded, processed and cancelled. We will collect, save and process this data in accordance with the Data Protection Act.
Section 4 Cancellations
4.1 Right to cancel
You may cancel your order and your agreement with us within 14 days of receiving the goods without providing a reason in written form (for example, a letter or email) or – if the item is sent to you within that time – by returning the item to us.
The cancellation period is 14 days from the date on which you or a third party designated by you who is not the carrier took possession of the goods.
Your cancellation will be considered to be within the cancellation period so long as your notice to exercise your right to cancel was sent before the expiration of the cancellation period.
4.2 How to Cancel an Order
To cancel an order please call our customer service team on 0871 200 3414, between 8.30 am to 5 pm Monday – Wednesday or between 8.30 am to 4 pm on Thursday and Friday.
If you wish to return a product(s) that have already been despatched or delivered to you, please refer to the instruction provided under 'How to return a product'.
4.3 Refunds Policy for Cancellations
4.3.1 If you cancel an order for a product(s) that you have already paid for and that have not been despatched to you, we will refund the amounts to you, including any delivery charges.
4.3.2. If you cancel an order after we have already despatched the products to you, we will not be able to cancel your order and process any refund until after it has been returned to us and you will still have to pay the delivery charge.
4.3.3 Products must be returned within 14 days of them being delivered to you.
4.3.4 Once the items have been returned to us, we will process any valid refund for the items themselves, but we will not refund any charges for delivery of the items to you.
4.3.5 You will have to pay for goods you do not return.
4.3.6 You will have to pay for products that are returned to us and that are damaged.
4.3.7 We will issue a refund within 14 days of receiving any valid returns.
4.3.8 If you are not a consumer, the right to cancel does not apply.
4.3.9 The right of cancellation does not apply in the case of distance sales agreements for delivery of goods in sealed packages that are not suitable for return for health protection or hygiene reasons if the seal has been removed after delivery.
Section 5 Product Prices and Shipping costs
5.1 All product prices within the GROHE online shop are inclusive of VAT.
5.2 Shipping Costs will be itemised seperately.
5.3 We will deliver via UPS or another provider of our choice.
Section 6 Delivery conditions
6.1 Unless otherwise indicated in the offer, the goods will normally be delivered within 7 days after receipt of payment.
Section 7 Payment conditions
Payment for goods purchased can be made by credit card, debit card or your Paypal account. The amount is deducted from your credit card, debit card Paypal account after you have received confirmation of order acceptance via e-mail.
Section 8 Warranty and liability
The warranty is made in accordance with legal regulations.
8.1 The images of the goods on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer's display of the colours accurately reflect the colour of the goods. Your goods may vary slightly from those images.
8.2 If the goods are faulty, we are under a legal duty to supply goods that are in conformity with this contract.
As a consumer, you have legal rights in relation to goods that are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these terms will affect these legal rights.
8.3 Manufacturer's guarantee
8.3.1 The goods come with a manufacturer's guarantee. For details, please refer to the manufacturer's guarantee provided with the goods. This guarantee is in addition to, and does not affect, your legal rights in relation to the goods that are faulty or not as described.
8.4 Our guarantee of goods
8.4.1 We guarantee that on delivery and for the period of warranty provided, the goods shall be free from material defects. However, this guarantee does not apply in the circumstances described in paragraph 8.4.2.
8.4.2 This guarantee does not apply to any defect in the goods arising from:
fair wear and tear; wilful damage, abnormal storage or working conditions, accident, negligence by you or by any third party; if you fail to operate or use the goods in accordance with the user instructions; any alteration or repair by you or by a third party who is not one of our authorised repairers; and any specification provided by you.
8.4.3 This guarantee is in addition to, and does not affect, your legal rights in relation to the goods that are faulty or not as described.

Section 10 Data protection
10.1 Data collection: We collect data when you place an order, and when an order is concluded, processed and cancelled. We will collect, save and process this data in accordance with the Data Protection Act.
Your visit to our websites will be recorded. Primarily, the current IP address used by your PC, the time and date, the browser type, your PC's operating system as well as the sites you viewed are collected.
10.2 Transmission and usage of data: Personal data communicated to us when an order is made or via e-mail (for example, your name, address or e-mail address) will be processed only in correspondence with you and for the purposes for which you made the data available to us. We provide your data only to the shipping company designated for the delivery in so far as it is necessary for the delivery of the items. For payment processing, we pass on your payment data to the credit institution designated for your payment.
Furthermore, we ensure that your personal data will not be passed on to third parties except for the implementation and development of manufacturing, fulfilment or delivery processes, if you give us your prior consent or we are legally obliged to do so.
10.3 Consent and cancellation: If you provide us with personal data, you can request that we delete it at any time. Data for invoicing and bookkeeping purposes is not affected by a cancellation/withdrawal and/or a deletion.
10.4 Term of storage: Personal data communicated to us via our website is stored and we will use the personal information you provide to us to:
10.4.1 Provide the goods;
10.4.2 Process your payment for such goods; and
10.4.3 Inform you about similar products or services that we provide, but you may stop receiving these at any time by contacting us.
If trade and tax retention periods are to be observed, the term of storage for certain data is up to 10 years.
10.5 You agree that we may pass your personal information to credit reference agencies and that they may keep a record of any search that they do.
10.6 You agree that we may pass your personal information to trusted third party to inform you about similar products or services that we provide, but you may stop receiving these at any time by contacting us.
10.7 Use of cookies: The use of our offer is made possible by applying cookies. In order for this to work, you need to have activated cookies in your browser settings.
A randomly generated session code and, where necessary, your customer ID will be saved in the cookie. This makes it possible to recognise you as a registered customer.

10.8 Google Analytics: This website uses Google Analytics, a web analysis service provided by the company Google. Google Analytics uses "cookies", which are text files that are saved on your computer and make it possible to analyse your use of the website. The information obtained through cookies regarding your use of this website is transferred to a Google server stored there. Google may use this information in order to evaluate your use of the website, compile reports about website activities for website operators and provide additional services associated with website and Internet usage. You can prevent the installation of cookies with the corresponding setting in your browser software; however, we would like to point out that if you do so, you may not be able to use all of the website's functions. 10.9 Your rights, information: If you no longer agree to have your personal data stored or if such data becomes incorrect, once we are informed of this we will have your data deleted or locked or make the necessary corrections (as long as this is legally permissible). You may request a disclosure, free of charge to you, of all the data we have saved about you.

Section 11 Applicable law, place of jurisdiction
11.1 These Terms are governed by English law. You and we both agree to submit to the non-exclusive jurisdiction of the English courts. However, if you are a consumer you may also bring proceedings in Northern Ireland if you are a resident of Northern Ireland, or in Scotland if you are a resident of Scotland.
11.2 The contract language is English.
11.3 If one or more of the provisions of these general terms and conditions should prove to be ineffective, all other provisions of the contract shall remain valid. Unless the provisions are ineffective, the contents of the contract comply with the law.
